THE ELEPHANT HOSTEL

GENERAL TERMS AND CONDITIONS OF THE Elephant Hostel B.V. (REGISTERED WITH THE DUTCH CHAMBER OF COMMERCE UNDER NUMBER 87412063, “The Elephant Hostel”).

1. Definitions and Interpretation
1.1. In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

Customer: The natural person(s) to whom one or more hospitality services must be provided by The Elephant Hostel at a price payable by the Customer;

The Elephant Hostel: The Elephant Hostel location to which the reservation applies;

Rates: The prices payable for beds and (where applicable) other facilities offered by The Elephant Hostel;

No Show: A guest not arriving at the hostel on the date of arrival of their reservation without prior notice to The Elephant Hostel.

2. Bookings and Reservations

2.1. Customers may make reservations in advance through The Elephant Hostel’s website or third-party booking websites on which The Elephant Hostel is advertised.
2.2. Customers are required to provide identification (passport or driver’s license) and information including, but not limited to, their name, address, contact telephone number, nationality, and email address. In case no authorised credit card can be presented, The Elephant Hostel withholds the right to deny entrance to the hostel.
2.3. Customer shall pay the reservation in full at least 48 hours prior to arrival.
2.4. Reservations booked in advance do not constitute a legally binding contract between The Elephant Hostel and the Customer until The Elephant Hostel confirms the reservation with the Customer and provides the Customer with a booking reference.
2.5. The Customer may request a change to his/her reservation at any time prior to arrival (subject to the cancellation provisions set out in Clause 4 below). The Elephant Hostel will use all reasonable endeavours to accommodate any changes requested but gives no guarantee that all changes can be accommodated.
2.6. Reservations are not required. Customers may make bookings on arrival; however, The Elephant Hostel cannot guarantee the availability of rooms or other facilities for such bookings. The Elephant Hostel does not accept walk-in reservations after 23:00hrs.
2.7. Customers may request additional nights at The Elephant Hostel at any time during their stay. The Elephant Hostel will use all reasonable endeavours to accommodate such requests.
2.8. For reservations for groups of more than 10 persons, the Customer is required to send an email to The Elephant Hostel for the request of a group reservation. The Elephant Hostel will then verify whether such a reservation is possible. If separate reservations are made resulting in a group of more than 10 persons, The Elephant Hostel holds the right to refuse such a group upon check-in.
2.9. The Elephant Hostel reserves the right to reject requests for reservations or cancel them if it has proof that, due to the characteristics of the Customer or the intended use of the reservation, it is morally justified to refuse the request for reservation based on widely recognized and accepted ethical values and human rights.


3. Fees and Payment

3.1. Details of Rates including, where applicable, promotional Rates and other special offers are available on The Elephant Hostel’s website.
3.2. Rates and prices quoted when making reservations only apply to accommodation unless otherwise stated. Additional charges may apply including, but not limited to City tax, food, drinks, and other services The Elephant Hostel might be offering. These additional charges are to be paid on the spot.
3.3. The Elephant Hostel may from time to time offer promotional Rates. The following provision applies:
3.3.1. Additional nights requested under sub-Clause 2.7 above shall be charged at the standard published Rate.
3.4. The Elephant Hostel may offer non-refundable Rates. The following provisions apply:
3.4.1. Advance payments made under sub-Clause 3.4 above are non-refundable.
3.4.2. Any deposits or booking fees paid at the time of reservation are non-refundable.
3.5. The following payment methods are accepted by The Elephant Hostel:
3.5.1. Credit Cards – Visa, Mastercard.
3.5.2. Debit Cards – Maestro, Vpay.
3.5.3. We do not accept cash in any currency.


4. Cancellations

4.1. Subject to sub-Clause 4.2 below, reservations may be cancelled if the Customer gives notice 24 hours before arrival (local GMT time) of their reservation.
4.2. In the event that the Customer has paid in advance under the provisions of sub-Clause 3.4, no refunds shall be made in the event of cancellation.
4.3. Failure to provide the required notice of cancellation before 14:00hrs on the day of arrival shall result in the Customer being charged for one night’s accommodation at the Rate specified in their reservation (Fully Flexible Rate or Non-Refundable Rate).
4.4. In case of a No Show, the Customer is charged for their full stay. No refund will be provided.
4.5. In case of a No Show, the subsequent nights, if any, will be cancelled. Therefore, the Customer must inform The Elephant Hostel if he/she is delayed getting to The Elephant Hostel.
4.6. The Elephant Hostel may, in an exceptional case, cancel a reservation. In the event of such cancellation, the Customer shall be informed immediately and shall be offered a full refund of any and all sums paid. Where a refund is offered under this sub-Clause 4.6 only, the provisions of sub-clauses 3.4 and 4.2 pertaining to advance payments shall not apply and a refund shall be payable.


5. Check-in and Check-out

5.1. Customers can check-in at The Elephant Hostel from 2pm.
5.2. Check-out time at The Elephant Hostel is 12pm. Failure to check-out by 12pm may result in the Customer being charged for an additional night’s accommodation at the standard applicable Rate.
5.3. A key/card and/or a coded bracelet is provided during the Check-in process, giving the Customer access to the room. For any loss or damage of the keycard, the guest will be charged 2 euros. For any loss or damage of the bracelet, the guest will be charged 5 euros. A laundry bag is provided during the Check-in; during the check-out, the Customer is obligated to return this laundry bag.
5.4. Only Customers with a valid reservation are allowed to enter The Elephant Hostel.


6. Hostel Rules

6.1. Customers are required to always behave in a reasonable and responsible manner when staying at The Elephant Hostel and must not act in any way which may disturb other guests. Any Customer who, in the opinion of our staff, disrupts the comfort, safety, or security of other guests, staff, or local residents is required to leave the hostel premises and will not be given a refund and all sums due shall become immediately payable.
6.2. Customers are bound to “The Elephant Hostel Rules,” available upon request and displayed in The Elephant Hostel dorms.
6.3. Customers shall be charged for any and all damage caused by them to The Elephant Hostel’s property during their stay. A minimum additional cleaning penalty of €250 will be applied in case of an extremely dirty bed and/or sleeping dorm area. In case the Customer used a credit card for the reservation, the Customer hereby agrees that The Elephant Hostel may deduct this penalty amount via the credit card.
6.4. Smoking traditional and electronic cigarettes is not permitted in any indoor area of The Elephant Hostel. Failure to adhere to these requirements shall result in the Customer being charged for any and all costs incurred by The Elephant Hostel in cleaning the room (including, but not limited to, fixtures, fittings, and soft furnishings), restoring it to a smoke-free environment, and paying off local fire hazard penalties and costs with a minimum of €400 per case for The Elephant Hostel. The Elephant Hostel will subsequently instruct the Customer to leave the premises immediately. A refund will not be issued.
6.5. No animals are allowed in The Elephant Hostel.
6.6. The Elephant Hostel maintains a maximum stay of 14 days for Customers.
6.7. The Elephant Hostel welcomes children of all ages. Babies and young children up to the age of 14 must stay in a private or family room with their parents. Children aged 14 to 16 may stay in dormitory rooms, provided they are accompanied by a parent or legal guardian. Guests aged 16 to 18 are permitted to stay unaccompanied, provided they present a signed parental authorization form at check-in.
6.8. Any Customer found using drugs (including the use of marihuana in any form) within The Elephant Hostel will be asked to leave the premises immediately. A refund will not be issued.
6.9. We do not serve alcohol to anyone under the age of 18.
6.10. The Elephant Hostel reserves the right to inspect the Customer’s bed and sleeping area after one week, in order to dust and clean.
6.11. Besides the mixed dorms, The Elephant Hostel has a ladies-only dorm, specifically designated for female guests who wish to have sleeping accommodations occupied solely by persons of their own gender, with more privacy, clothing hangers, and shower facilities. This dorm is available to female guests only. The Elephant Hostel refers to the legal qualification for female, as evidenced in the passport of the guest.


7. Food and Drinks

7.1. Unless expressly indicated otherwise, food and drinks are not included in any Rates and will be charged for in accordance with sub-Clause 3.2 above.


8. Limitation of Liability

8.1. To the fullest extent permissible by law, The Elephant Hostel’s liability for any loss or damage suffered by Customers shall be limited to that which arises out of the negligence of The Elephant Hostel’s employees, subcontractors, or agents.
8.2. Notwithstanding sub-Clause 8.1 above, The Elephant Hostel shall not be liable for any indirect loss or damage which may be suffered by a Customer including, but not limited to, loss of income, loss of business, loss of profits, loss of opportunity, loss of anticipated savings, loss of data, or lack of enjoyment.
8.3. The Elephant Hostel shall not be liable for damage to or loss of goods that were taken to The Elephant Hostel by a Customer. The Customer indemnifies The Elephant Hostel against claims in connection therewith. The provisions set forth here are not applicable to the extent that the damage or the loss can be blamed on intent or gross negligence of The Elephant Hostel.
8.4. Liability of The Elephant Hostel is limited to the amount that can within reason be insured.
8.5. The Elephant Hostel provides personally accessible, well-functioning lockers to every Customer. Nonetheless, The Elephant Hostel shall not be liable for any loss and/or damage to items stored by the Customer in the locker.


9. General

9.1. These Terms and Conditions constitute the entire agreement between The Elephant Hostel and the Customer with respect to the subject matter contained herein.
9.2. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9.3. The Elephant Hostel reserves the right to amend, modify, or update these Terms and Conditions at any time without prior notice. Customers will be informed of any significant changes via email or notice on The Elephant Hostel’s website.
9.4. These Terms and Conditions are governed by the laws of The Netherlands and any disputes will be subject to the jurisdiction of the courts in Amsterdam, The Netherlands.


10. Data Protection

10.1. The Elephant Hostel processes personal data in accordance with the General Data Protection Regulation (GDPR). All personal data provided by customers will be processed solely for the purpose of fulfilling the terms of service, including reservations and customer communication.
10.2. Personal data collected by The Elephant Hostel includes but is not limited to: name, email address, telephone number, payment details, identification documents (e.g., passport or driver’s license), and booking information.
10.3. The Elephant Hostel may use personal data for sending marketing communications, newsletters, and special offers, provided that the customer has consented to receiving such information.
10.4. Customers have the right to access, correct, or delete their personal data at any time by contacting The Elephant Hostel.
10.5. The Elephant Hostel will take appropriate measures to ensure the security of personal data and prevent unauthorized access or disclosure.
10.6. Personal data will be retained only as long as necessary for the purpose it was collected for, after which it will be securely deleted or anonymized.


11. Force Majeure

11.1. Every foreseen or unforeseen, foreseeable or unforeseeable, circumstance that hinders the implementation of the agreement between The Elephant Hostel and the Customer such that the implementation of the hospitality agreement becomes impossible or burdensome (such as natural disasters, flooding, earthquake damage, etc.) shall be qualified as force majeure on the part of The Elephant Hostel, which implies that a potential shortcoming of the hospitality business cannot be blamed on the same.


12. Lost and Found

12.1. Objects lost or left behind in The Elephant Hostel that are found by the Customer must be directly presented to a representative of The Elephant Hostel.
12.2. The Elephant Hostel acquires the title of objects whose rightful owner did not report to The Elephant Hostel within one year after the object was left behind at The Elephant Hostel.
12.3. If The Elephant Hostel sends objects left behind by the Customer to the Customer, this shall take place entirely at the risk and expense of the Customer.


13. Law and Jurisdiction

13.1. These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, Dutch law.
13.2. Any dispute, controversy, proceedings, or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of The Netherlands.
13.3. The invalidity of one or more of the provisions of these Terms and Conditions shall not affect the validity of all other provisions. If a provision of these Terms and Conditions appears to be invalid, for any reason whatsoever, then the parties are deemed to have stipulated a valid alternative provision that best approaches the scope and application of the invalid provision.


14. Privacy and Personal Data

14.1. The Elephant Hostel processes personal data in accordance with the General Data Protection Regulation (GDPR). All personal data provided by customers will be processed solely for the purpose of fulfilling the terms of service, including reservations and customer communication.
14.2. Personal data collected by The Elephant Hostel includes but is not limited to: name, email address, telephone number, payment details, identification documents (e.g., passport or driver’s license), and booking information.
14.3. The Elephant Hostel may use personal data for sending marketing communications, newsletters, and special offers, provided that the customer has consented to receiving such information.
14.4. Customers have the right to access, correct, or delete their personal data at any time by contacting The Elephant Hostel.
14.5. The Elephant Hostel will take appropriate measures to ensure the security of personal data and prevent unauthorized access or disclosure.
14.6. Personal data will be retained only as long as necessary for the purpose it was collected for, after which it will be securely deleted or anonymized.


15. Complaints and Feedback

15.1. If the customer is dissatisfied with any aspect of their stay, they should immediately inform The Elephant Hostel staff to allow them the opportunity to address the issue.
15.2. If the issue cannot be resolved during the stay, the customer may submit a formal complaint by email to info@theelephanthostel.com.
15.3. The Elephant Hostel will make reasonable efforts to address all complaints in a timely and effective manner.
15.4. Customer feedback is highly valued and may be used to improve the quality of services and the guest experience.


16. Miscellaneous

16.1. These Terms and Conditions constitute the entire agreement between The Elephant Hostel and the Customer with respect to the subject matter contained herein.
16.2. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
